Il 19 ottobre 2007 la procura di Catanzaro, nella persona di Dolcino Favi (avvocato generale dello Stato e procuratore generale reggente a Catanzaro), ha avocato a sé, per presunta incompatibilità, l’inchiesta, sottraendola a De Magistris. Il Pg facente funzioni ha inoltre disposto che la notizia venisse ufficialmente comunicata al P.M. solo il 22 ottobre. De Magistris dichiarerà infatti in un’intervista a Repubblica di esserne venuto a conoscenza dalla stampa.
